The contract of purchase states that the buyer agrees to accept the property at settlement in its condition at the time of contract acceptance, wear and tear excepted. For example, if the garbage disposal breaks down between contract and settlement, the seller will repair it at his cost, as a working disposal is the condition the buyer originally saw the property in. The seller signs that all appliances, heating and cooling systems, plumbing and electrical will be in working order at the time of settlement. The seller agrees to convey the property in "broom clean" condition and to exercise reasonable and ordinary care in the maintenance and upkeep of the property between the date the contract is executed and the time of settlement. The seller will also provide the buyer, the buyer’s inspectors and engineers, selling company, and lender representatives reasonable access to the property to conduct inspections and appraisals as appropriate and in compliance with the contract. The seller will have all utilities in service at the time of the inspections, including final walk-through.
